This website is operated by Trustfirst Properties, LLC, a Texas limited liability company doing business as Trustfirst Title Solutions ("we," "us," "our"). By using this site you agree to these terms. If you don't agree, don't use the site.
1. What we are, and what we are not
We research and purchase real property that has a distressed or defective title. In any transaction we pursue, we are the buyer, acting for our own account and in our own interest.
We are not:
- a title insurance company or title insurance agent, and we do not issue title insurance policies;
- an escrow, closing, or settlement agent;
- a licensed real estate broker or sales agent, and we do not represent buyers or sellers;
- a law firm or attorney, and we do not provide legal advice;
- a genealogist, accountant, financial advisor, or fiduciary of any kind to you.
We are not licensed by the Texas Department of Insurance or the Texas Real Estate Commission, because the activity described on this site does not require those licenses. Nothing here should be read as a claim to hold any license we do not hold.
2. Not advice
Everything on this site is general information about what we do. It is not legal, tax, financial, or real estate advice, and it is not a substitute for advice from a professional who represents you. Property law, probate, and heirship are fact-specific and vary case by case. Before you sign anything with us, have it reviewed by your own attorney. We encourage this.
3. No offer, no contract
Nothing on this website is an offer to purchase any property, and nothing here creates a contract between us. Any purchase offer we make is separate, specific to a property, and non-binding until a written purchase agreement is signed by both parties. Statements about price, timing, or process on this site are general descriptions, not commitments.
4. No relationship created by contacting us
Contacting us, submitting the form, or replying to a message from us does not create any agency, fiduciary, attorney-client, or representation relationship. We do not act on your behalf. Information you send us through this site is not confidential or privileged.
5. Accuracy of information
We work from public records, which are frequently incomplete, out of date, or wrong. We make no warranty that anything on this site, or any research result we share with you, is accurate or complete. Any conclusion we reach about ownership, heirship, or title is our working opinion, not a title opinion, an abstract of title, or a guarantee, and it should not be relied on as one.
6. Acceptable use
Don't use this site to break the law, to scrape or harvest data, to attempt unauthorized access, to interfere with its operation, or to submit false information or information about someone else without their permission.
7. Intellectual property
The content, design, and marks on this site belong to Trustfirst Properties, LLC. You may view and print pages for your own personal use. You may not republish, resell, or use them commercially without our written permission.
8. Third-party links
We are not responsible for the content or practices of any site we link to.
9. Disclaimer of warranties
This site is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the fullest extent permitted by law, Trustfirst Properties, LLC and its members, managers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any lost profits or lost data, arising out of your use of this site, however caused. Our total liability for any claim relating to this site will not exceed one hundred dollars ($100).
Nothing in these terms limits any liability that cannot lawfully be limited.
11. Indemnity
You agree to indemnify and hold us harmless from any claim arising out of your misuse of this site or your violation of these terms.
12. Governing law and venue
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to that jurisdiction and venue.
13. Changes
We may change these terms at any time. The "last updated" date will change when we do, and continuing to use the site means you accept the current version.
14. Severability
If any provision of these terms is held unenforceable, the rest stays in effect.
